Driver accused of DUI in fatal Virginia bicyclist accident

A Virginia woman is facing serious allegations after reportedly striking a bicyclist. She is accused of causing the fatal DUI accident on March 30, when she reportedly struck a 59-year-old cyclist as he was traveling on Franklin Road in Roanoke. The victim suffered catastrophic injuries; the driver is now accused of DUI manslaughter and drunk driving.

The 33-year-old woman is accused of striking the victim with her van while driving north on Franklin Road. She reportedly struck the victim's bike at 9:48 p.m. as he was riding in the right-hand lane. Authorities say that the woman's van sustained damage to its hood and windshield because of the impact.

Investigators found the woman in a parking lot near the crash site and transported her to the hospital for toxicology tests. Reports show that the woman's blood alcohol content level measured at 0.24 percent -- three times the legal limit -- nearly two hours after the crash. Officers have continued to evaluate witness statements and obtain warrants for a variety of documents, including the woman's medical records and cellphone history. That information may be used to determine whether the woman was potentially driving distracted.

Defendants who are facing DUI charges in conjunction with manslaughter allegations and other accusations often have special courtroom needs. These alcohol-related charges can have serious consequences; consider protecting your future by enlisting the help of a Virginia criminal defense attorney. These professionals may help you learn more about your legal rights, including additional information about BAC levels and legal search procedures. It is important to remember that an alleged drunk driver is not considered guilty simply because he or she was arrested and accused.
