Five things you probably shouldn’t do during a divorce

A number of our blog posts discuss some things you should do during the divorce process. What about things that aren’t a good idea when you’re dissolving a marriage? Here’s a look at five common mistakes you don’t want to make during a divorce.

First, you shouldn’t enter the divorce process on your own. Divorce can be an extremely complicated matter, particularly when children or a lot of property is involved. It’s also likely that you aren’t in the best emotional state during the process of ending your marriage. Therefore, a family law attorney can help you stay on target and avoid leaving important matters for later disputes.

Speaking of emotions, it’s important not to let anger or grief govern too much of your divorce process. Losing your cool during the process rarely bodes well for the outcome, and lashing out at family members — including your ex — can actually damage your case if the divorce ends up in court.

Lashing out could include violating temporary agreements, particularly with regard to custody. This is another thing you should avoid during the divorce process. Whether on purpose or through a simple misunderstanding, violating custody can weaken your case for custody later or make it more difficult to argue for the custody arrangement you really want.

You definitely shouldn’t take your children out of state without notice to the other party and during the middle of a divorce is not a good time to plan a major relocation. This is especially true if you have children. A major move before a divorce is finalized could interfere with the progress of the divorce.

Finally, don’t try to circumnavigate the legal process for property division. Hiding assets or giving them to others with the intention of receiving them back in the future just sets you up for potential future court battles, which can be expensive and stressful.
