Military divorces can be complex and tricky

Being in the military means that you have taken on more responsibility than many others. Your relationships likely take a backseat to your duties. This can be hard on your marriage. If you are in the military and facing a divorce, you should make sure that you understand how a divorce can affect you.

There are several different ways that a military divorce differs from other divorces. One of these is that you have to determine where you should file for your divorce. There are three possibilities. You can file where you live. You can file where your permanent address is located. Your spouse can file where he or she lives. In all cases, residency requirements would have to be met.

If you have had a lengthy marriage or if you are nearing retirement, you should find out how the divorce could affect your retirement pay. In some cases, your former spouse would be eligible to receive certain benefits even after the divorce. Understanding those laws is crucial.

Child custody matters are another issue that you will have to face. These can be complex because of the moving and deployments that are common in the military. That doesn’t mean that you can’t get custody of your child or have the right to visitation. It simply means that plans have to be made.

It is important that you prepare yourself for the process if you are going to file for a divorce while you are serving. This is the only way that you can ensure that you don’t make snap decisions that can harm your case.
