Virginia Beach to assign prosecutors to all DUI cases

All DUIs will now be handled by prosecutors in Virginia Beach, even first-time offenses, which were usually processed by police officers.

Virginia has a well-known reputation for being extremely tough on drunk driving. Even first-time offenders can expect to lose their driving privileges for a substantial period of time. Those with multiple offenses on their record will be forced to spend time in jail, pay fines and court costs in addition to the loss of license.

Recently, the state passed a new law that increases the use of ignition interlock devices. The changes call for ignition interlock devices for first-time DUI offenders during the period of restricted driving privileges, even if the courts did not originally require these devices. These changes go into effect in the beginning of July.

This is an extremely important development for individuals in Virginia Beach, due to some changes happening within the area. The city is taking a very aggressive approach to drunk driving by pledging to prosecute every single DUI case, even first-time offenders. Currently, the city uses police officers to handle the majority of these cases without prosecutors.

Now, prosecutors will assist on all cases going through the system. A separate courtroom is being devoted solely to DUIs in the hopes that it will help cases proceed much quicker, but there is no guarantee that this will help avoid a huge backlog of DUIs. The city is making the changes due to the complex nature of DUI law. The increased penalties make it much more difficult for officers to handle these cases on their own.

With prosecutors being assigned to all of these cases, individuals need to be sure they have someone on their side. If you have been arrested for DUI, it is important that you remember that you have rights that you need to protect. Do not discuss any facts with officers until you have had the opportunity to contact an experienced criminal defense attorney. Your attorney will be able to be present for any conversations that take place and can offer you advice at such a crucial point in the process.

With prosecutors pledging to be more aggressive in these kinds of cases, you need to be sure that you are aware of the seriousness of these offenses. You do not want to be taken by surprise by some of the penalties that will be imposed if you are eventually convicted. Be sure that you work with an attorney who has experience in the courtroom, so that if your case ends up going to trial, you will be prepared to present a strong defense.
