In Virginia, spousal support can be pursued in either circuit court or juvenile court.
- Circuit court: In a divorce, typically the court will stipulate temporary (pendente lite) support that will last through the duration of litigation. The court will carefully examine the client’s financial needs versus earning potential. At the conclusion of litigation, the court will rule on final support. Most often, the central determining factor is the duration of marriage. Whether the marriage is considered long term (lasting 20 years) or short term (lasting 10 years) can lead to a difference in final support.
- Juvenile court: Here, a set of guidelines completes most of the calculation of the support amount. The award is temporary, however, and it can be difficult to arrive at an accurate number. The most challenging aspect lies in establishing what each party’s income is. This requires discovery, including reviewing financial records as well as tax statements and investments.
